Saudi Final Exit: Process and Settlement Rights

When you decide to leave Saudi Arabia permanently — whether by choice, contract end, or termination — the final exit process determines how quickly you depart and how much you receive. The Labour Reform Initiative changed the rules significantly. Here is the complete process.

How to Apply for Final Exit

Under the Labour Reform Initiative, private sector workers can apply for final exit through Absher without employer consent in qualifying situations. Log into Absher, navigate to Passport Services, and select "Final Exit Visa Issuance."

Your employer is notified but cannot block the process if you meet the criteria: contract ended, wages unpaid for 2+ months, or you have served the required notice period. The visa is typically issued within 3 working days.

Your Settlement Entitlements

Saudi Labour Law (Articles 84-86) guarantees specific end-of-service payments.

End-of-service gratuity: Half month's basic salary for each of the first 5 years of service. Full month's basic salary for each year after 5 years. Partial years are calculated proportionally.

Unpaid wages: All salary owed up to and including your last working day.

Annual leave balance: Cash compensation for any unused annual leave days at your daily rate.

Repatriation ticket: Your employer must provide a ticket to your home country. If you arrange your own travel, the employer must reimburse the cost of an economy class ticket.

Gratuity Calculation Examples

If you earned SAR 5,000 basic salary and worked for 8 years: first 5 years = SAR 2,500 x 5 = SAR 12,500. Next 3 years = SAR 5,000 x 3 = SAR 15,000. Total gratuity = SAR 27,500.

Resignation vs termination: If you resign before completing 2 years, you receive no gratuity. Between 2 and 5 years of resignation, you receive one-third of the gratuity. Between 5 and 10 years, two-thirds. After 10 years of resignation, you receive the full amount. If terminated by the employer, you receive full gratuity regardless of service length (minimum 2 years).

Timeline and Departure

Once the final exit visa is issued, you have 60 days to leave Saudi Arabia. Your iqama is cancelled on the issue date. Your employer must pay all settlement amounts within one week of your last working day (Article 88).

If your employer fails to pay settlement within one week, you can file a complaint with HRSD even after leaving Saudi Arabia. HRSD can pursue the employer and enforce payment through the Labour Court. Keep copies of your contract, pay slips, and exit documents.
