Pakistani Workers UAE Rights: What Your Contract Must Include

Pakistani workers in the UAE have the same legal protections as any other nationality under Federal Decree-Law No. 33/2021. But systemic issues — wage delays, accommodation standards, heat exposure — disproportionately affect Pakistani labourers in construction and services. Know your rights so you can enforce them.

Wage Protection for Pakistani Workers

The Wage Protection System requires your employer to pay your full salary through an approved bank or exchange house. For Pakistani workers earning below AED 5,000, salary is typically paid through exchange houses like Al Ansari or UAE Exchange. The WPS records every payment — amount, date, and recipient.

If your WPS payment is less than your contract salary, this is a recorded violation. If payment is late by more than 15 days, MoHRE is automatically alerted. Keep your own records — photograph every pay slip, note every cash payment, and save bank statements. These are your evidence if you need to file a complaint.

3 Rights Violations Pakistani Workers Must Watch For

Heat-Related Work Without Protection

Pakistani workers in construction, landscaping, and delivery face extreme heat exposure from April to October. Beyond the midday ban, employers must provide shaded rest areas, cold drinking water, and regular breaks during hot months. Many employers ignore these requirements. If you are forced to work in extreme heat without breaks or water, this is a health and safety violation. Document the conditions and report to MoHRE.

End-of-Service Gratuity Calculated on Lower Salary

A widespread issue: your total package is AED 3,000 but the MoHRE contract shows a basic salary of AED 1,200 with the rest as allowances. Your gratuity is calculated only on the AED 1,200 basic. After 10 years of service, this could mean a difference of AED 15,000-20,000 in your end-of-service payout. Check your MoHRE-registered basic salary now.

Passport Confiscation Still Happening

Despite being illegal since 2006, passport confiscation remains common for Pakistani workers in construction and domestic sectors. Employers claim it is for 'safekeeping' but it prevents workers from leaving the country or changing jobs. If your passport is held by your employer, report it to the Pakistani Consulate (+971-4-3970600) or MoHRE. This is a criminal offence under UAE law.

Pakistani Consulate Support

The Pakistani Consulate in Dubai and Embassy in Abu Dhabi can assist with labour disputes, passport confiscation cases, and repatriation. They also maintain a welfare fund for stranded workers. If you are in a situation where your employer has abandoned you or cancelled your visa without paying dues, contact the consulate immediately.

The Community Welfare Attache at the Consulate handles labour complaints and can escalate cases with MoHRE on your behalf. This is particularly useful if you do not speak Arabic or English well enough to navigate the complaint process yourself.

Frequently Asked Questions

What are the midday work ban rules for Pakistani construction workers?

From 15 June to 15 September, outdoor work is banned between 12:30 PM and 3:00 PM. This applies to all construction, delivery, and outdoor workers. Employers violating this face fines of AED 5,000 per worker per instance. If your employer forces you to work during the midday ban, report it to MoHRE immediately. The ban was introduced because of heat-related deaths among construction workers, many of whom were Pakistani and South Asian nationals.

Can my employer cancel my visa without paying my dues?

No. Your employer must settle all outstanding salary, gratuity, and leave balance before or at the time of visa cancellation. Under UAE law, cancelling your visa does not cancel your right to unpaid wages. If your employer cancels your visa without settling dues, you have 30 days to file a complaint with MoHRE. You can also request a temporary work permit to stay in the UAE while your case is resolved.

What rights do Pakistani workers have regarding accommodation?

If your contract includes accommodation, the employer must provide housing that meets MoHRE standards: minimum 3 square metres per person, proper ventilation, clean water, functioning toilets (1 per 8 workers), and kitchen facilities. The accommodation must be within reasonable distance of the worksite. If conditions are substandard, report to MoHRE or the municipality. You can also contact the Pakistani Consulate for assistance.
